These Terms of Service govern your use of charlesandthatch.com and any purchase made through the site.

Throughout these Terms, “Charles & Thatch,” “we,” “us,” and “our” refer to Charles & Thatch. “You” refers to anyone who visits the site, creates an account, or places an order.

By using this website or purchasing from Charles & Thatch, you agree to these Terms of Service and the policies referenced within them. If you do not agree to these terms, please do not use the site.

USING THE SITE

You may use this website only for lawful, personal purposes.

You agree not to interfere with the site’s operation, attempt to gain unauthorized access to it, introduce malicious code, collect information about other users, copy or exploit its content, or use it in a way that violates the rights of Charles & Thatch or another person.

If you create a customer account, you are responsible for keeping your account information accurate and your login credentials secure.

You must be at least the age of majority in your state of residence to make a purchase, or use the site with the permission of a parent or legal guardian.

OUR PRODUCTS

Charles & Thatch goods are made from natural materials and prepared individually at the bench.

Full-grain leather naturally varies in grain, tone, texture, and marking. These differences are part of the material and do not constitute defects. Leather will also soften, darken, and develop character through use.

We work to represent every product and leather color accurately. Screen settings, lighting, and natural variation may cause the piece you receive to differ slightly from the photographs shown online.

Product descriptions, pricing, availability, and specifications may be updated when necessary. We may discontinue a product or limit available quantities at any time.

MARKS, INITIALS & PERSONALIZATION

Customers are responsible for reviewing all personalization choices before placing an order, including the selected Guild Mark, leather color, hardware, stitching method, handle option, and initials.

Initials must follow the personalization requirements shown on the product page. Charles & Thatch may contact you if the information submitted cannot be completed as requested.

Pieces bearing initials are made for a particular person and are final sale, except when the item arrives damaged, defective, incorrectly made, or fails because of a defect in materials or craftsmanship.

Eligibility for returns is governed by our Return & Refund Policy.

ORDERS

Submitting an order is an offer to purchase from Charles & Thatch. An order is accepted when payment has been processed and we confirm the order.

Please review the entire order carefully before submitting it.

Changes or cancellations may be requested within 12 hours of placing an order. After that period, changes and cancellations are not guaranteed because work may have begun.

We reserve the right to decline or cancel an order when necessary, including in cases involving incorrect pricing, suspected fraud, unavailable materials, payment problems, or an order we are unable to fulfill as requested.

If we cancel an order after payment has been received, the amount paid for the canceled portion will be refunded to the original payment method.

PRICES & PAYMENT

Prices are listed in U.S. dollars and may change without notice.

The price charged will be the price displayed when the order is placed. Shipping charges and applicable taxes are added at checkout unless otherwise stated.

You agree to provide current, complete, and accurate billing, payment, and contact information. By submitting payment information, you confirm that you are authorized to use the selected payment method.

Promotions and discount codes may carry additional conditions. Unless expressly stated otherwise, discounts cannot be combined or applied to an order after it has been placed.

SHIPPING & DELIVERY

Charles & Thatch currently ships within the United States using USPS Ground Advantage and USPS Priority Mail.

Guild Mark pieces normally leave the bench within 1–3 business days. Initials pieces normally leave the bench within 3–5 business days. Production may require additional time during holidays, launches, or periods of unusually high demand. Carrier delivery dates are estimates and are not guaranteed.

Customers are responsible for providing an accurate and complete shipping address.

RETURNS, REFUNDS & THE GUARANTEE

Eligible Guild Marks pieces may be returned in accordance with our Return & Refund Policy. Initials pieces are final sale except when damaged, defective, or incorrectly made.

The Charles & Thatch Guarantee applies to defects in materials or craftsmanship:

Buy it once. Carry it for life.

Every Charles & Thatch piece is made to be used, carried, and allowed to age. If your product ever fails because of a defect in materials or craftsmanship, we’ll repair or replace it at no charge.

No expiration. No hassle. Just our commitment to the work.

The guarantee does not cover ordinary changes created by use and aging, including patina, softening, darkening, surface marks, or other characteristics expected of natural leather. It also does not cover loss, theft, intentional damage, improper use, or alterations made by someone other than Charles & Thatch.

Nothing in these Terms limits any rights that cannot legally be limited under applicable consumer-protection law.

ACCURACY OF INFORMATION

We work to keep product descriptions, prices, availability, production times, and other information accurate.

Occasionally, the site may contain an error or omission. We reserve the right to correct inaccurate information, update the site, or cancel an affected order. If a paid order is canceled because of an error, the appropriate amount will be refunded.

INTELLECTUAL PROPERTY

The Charles & Thatch name, logos, Guild Marks, original letterforms, product designs, written copy, photography, artwork, graphics, videos, and overall site presentation belong to Charles & Thatch or are used with permission.

These materials may not be copied, reproduced, modified, distributed, sold, published, or used commercially without prior written permission.

Purchasing a Charles & Thatch product does not transfer ownership of the artwork, Guild Mark, design, photography, or other intellectual property associated with it.

REVIEWS & CUSTOMER CONTENT

If you voluntarily submit a review, photograph, comment, testimonial, or other content to Charles & Thatch, you confirm that you created it or have permission to share it.

You grant Charles & Thatch permission to use, reproduce, and display that content in connection with the shop, its products, and its promotion. We may edit content for length or clarity, but we will not intentionally alter the substance of your experience.

We may decline or remove content that is unlawful, abusive, deceptive, unrelated, infringing, or contains private information.

THIRD-PARTY SERVICES & LINKS

The website may use or link to services operated by third parties, including payment processors, shipping carriers, review platforms, social networks, and other websites.

Those services are governed by their own terms and privacy practices. Charles & Thatch is not responsible for the availability, accuracy, security, or conduct of an independent third-party service.

PRIVACY

Our collection and use of personal information are described in our Privacy Policy.

The store is hosted by Shopify, which processes certain information needed to operate the site, complete transactions, and provide its services. Shopify’s processing of personal information is also governed by its applicable privacy policies.

SHOPIFY’S ROLE

Shopify provides the commerce platform that allows Charles & Thatch to operate this store.

Any purchase made through the store is a transaction directly between you and Charles & Thatch. Shopify is not the seller of Charles & Thatch products and is not responsible for their manufacture, sale, fulfillment, repair, replacement, or refund.

SITE AVAILABILITY & WARRANTIES

We work to keep the website accurate, secure, and available, but we cannot promise that access will always be uninterrupted or error-free.

Except for the express commitments made in the Charles & Thatch Guarantee and to the extent permitted by law, the website and its content are provided as available without additional express or implied warranties.

Some states do not allow certain warranty limitations, so portions of this section may not apply to you.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Charles & Thatch will not be liable for indirect, incidental, special, punitive, or consequential loss arising from use of the website or a purchase made through it.

Where liability cannot be excluded, Charles & Thatch’s total liability will not exceed the amount paid for the product or order giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

INDEMNIFICATION

You agree to be responsible for losses, claims, or reasonable legal expenses resulting from your unlawful misuse of the site, your violation of these Terms, or your infringement of another person’s rights.

GOVERNING LAW

These Terms and any dispute relating to the website or an order from Charles & Thatch are governed by the laws of the State of Oregon and applicable federal law, without regard to conflict-of-law principles.

Any legal proceeding will be brought in a court with proper jurisdiction in Oregon, unless applicable consumer law requires otherwise.

SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

CHANGES TO THESE TERMS

We may update these Terms when the shop, its services, or applicable requirements change.

The current version will always appear on this page with its effective date. Changes apply when posted unless a later date is stated or applicable law requires additional notice.
